【不当逮捕】コミュのナイジェリア国籍男性 冤罪事件

私の名前は、オサユワメン・イドゥボといいます。
ナイジェリア国籍でポーランド人と結婚しています。日本には18
年間住んでいて、横浜で「Big Y's Cafe」という飲食店を経営
しています。
私はそのBig Y's Cafeで2007年1月22日に加賀署の警官に逮捕
されました。容疑は身におぼえのないもので、告訴人の言うと
ころによれば酔っていた日本人女性を2006年11月1日の朝にレ
イプしたというものでした。逮捕は物証なく、一転二転して相
互にくいちがいのある申立てにのみ基づいて行なわれました。
あらゆる点から、この告訴人の女友達が彼女を利用して私に対
する訴訟を起こさせたと確信しています。告訴人の友人は私の
店の客でしたが、以前、私との間にトラブルがあったのです（
詳細は www.debito.org 参照）。警察は、私に有利な証拠を破
壊することによって彼女らを助けて起訴に至りました。告訴人
が店で酔っていたというのも事実に反します。
事件は逮捕から1年近くもたってから横浜地裁で審理されまし
た。拘留期間を通じて保釈は認められませんでした。
私の頭部全体には発疹ができ、髪が抜け始め、耳からは出血し
ていますが、充分な手当てを受けることは許されていません。
私は2007年12月10日に有罪判決を受け、禁固3年を言い渡され
ました。ただし、判決前の拘置期間が1年近くあり、そのうち7
ヶ月と20日が3年から差し引かれました。
私達は控訴し、その第1回公判が2008年3月24日に東京高裁で行
なわれます。8階の803号法廷で、午後3時からです。
私はこの犯罪を犯していません。私はレイピストではなく、犯
罪者でもありません。完全に潔白です。結婚しており、妻を心
から愛していますし、幸福な家庭を営んできました。
皆さんにお願いします。公判を傍聴して、私が無実を証明する
力となってください。そのほかあらゆる方法でのご支援をお願
いします。
この不当な告訴により、懸命に努力して築いてきた信用をはじ
めとする何もかもを失いました。無実を証明して、元の平穏な
生活を取り戻す手助けをしてください。私は無実です。レイピ
ストではなく、犯罪者でもなく、犯罪者の扱いを受けるいわれ
はありません。
どうか助けてください。私は無実です。

APPEAL
My name is Osayuwamen Idubor, a Nigerian national married
to a Polish national.
I have lived in Japan for 18 years and own a restaurant
bar called "Big Y`s Cafe" in Yokohama City.
I was arrested on January 22nd, 2007, in my bar Big Y`s
Cafe by the police from Yokohama Kagacho Police Station. I
was falsely accused of raping a Japanese
woman on the morning of November 1st, 2006, who said she
had been drunk. Without any material evidence, the police
arrested me based on the complainant's statements, which
keep changing and conflict with each other.
There is every reason to believe that the complainant's
female friend who was my bar's customer that I had a
problem with before (details on http://www.debito.org)
used the
complainant to set me up with this case, and the police
helped them out by destroying very valuable evidence in my
favour. The
complainant wasn't drunk in my bar.
The case was tried by the Yokohama District Court and took
almost a year since my arrest. I was denied bail
throughout the detention.
I have rashes all over my scalp and my hair is falling
out, and I have blood coming out from my ear, and yet I
have been denied sufficient medical treatment.
I was declared guilty on the 10th of December 2007 and was
sentenced to three years in prison, less 7 months and 20
days out of almost a year I was detained before the
verdict.
We have appealed to the Tokyo High Court. The hearing is
scheduled to start at 3:00 pm on March 24th, 2008 at Tokyo
High Court, 8th floor, in Court Room No.803.
I didn't commit this crime. I am completely innocent. I
am not a rapist. I am a married man and I love my wife
very much and I have a happy home.
I beg the public to please help me to fight this case by
attending the Court on the day of the hearing and
publicizing this case and in every other way you can help.
Because of this crime I am falsely accused of, I have lost
trust and everything I have worked very hard for. Please
help me prove my innocence so that
I can restore my life back to normal again.
I didn't commit this crime. I am not a rapist or a
criminal, and I don't deserve to be treated like a
criminal.
