Release Rs 356 cr for Dal dwellers’ rehabilitation: High Court to GOI
LAWDA Asked To Furnish Report Within Two Weeks

Srinagar, Dec 9: The High Court has asked the Ministry of Finance, Government of India, to sanction additional financial assistance of Rs 356 crore – already committed - for the rehabilitation of Dal Lake dwellers within three months.
“Three months time is granted to enable the Ministry of Finance in coordination with the Ministry of Environment and Forests to sanction the additional financial assistance of Rs 356 crore to enable the state government and LAWDA to carry out the rehabilitation of Dal dwellers,” says the court order.
The Division Bench comprising Chief Justice F M Ibrahim Kalifulla and Justice Hasnain Masoodi also asked LAWDA to furnish techno-economic justification within two weeks to the Ministry of Finance to enable it to sanction the amount.
The court, however, observed that the report furnished by LAWDA on November 2, 2011, was prepared in 2000 and the Authority is directed to prepare a fresh report vis-à-vis the financial assistance. In the Public Interest Litigation (PIL) on conservation of Dal Lake, the Amicus Curiae in the case on Thursday objected to the report submitted by LAWDA to the Central government on the grounds that the report contained excerpts of the report previously prepared by University of Roorkee.
The court passed the direction after the arguments of the Advocate General, M Ishaq Qadri, and the submission of the Amicus Curiae that LAWDA be directed to restrict its fresh report to the justification of the release of funds.
The Division Bench in its order passed on November 1, 2011, had directed the GOI to take appropriate action with regard to release funds to the tune of Rs 356 crores required by the state government for rehabilitation and acquisition process of Dal dwellers including their shifting from the lake. “For this purpose LAWDA was to submit techno-economic report justifying the release of funds and the report was perused by the court,” the Amicus Curiae, Z A Shah, told Greater Kashmir.
Advocate Naresh Kausik, representing Ministry of Finance and Ministry of Environment, Government of India, along with Assistant Solicitor General, S A Makroo, assured the court that the funds will be released within three months to enable the LAWDA to speed up acquisition and shifting of the Dal dwellers. The court directed for posting the case in the last week of February, 2012.

Government Proposes Concrete Cantilever Along The Boulevard
ARIF SHAFI WANI
Srinagar, Apr 5: In a surprising move with serious environmental ramifications on Dal Lake, the State Government is proposing to construct a concrete cantilever in the water body along tourist hub The Boulevard as part of its four-laning road project.
The development comes at a time when the ambitious multi-crore rupees Dal Conservation Project is going on in full swing and the lake’s condition has shown considerable improvement for past some years.
Highly placed sources privy to the matter told Greater Kashmir that the Roads and Buildings Department has forwarded the controversial proposal to the Government of India for sanction.
To tackle major traffic jams on the busy tourist hub, Chief Minister Omar Abdullah had approved the four-laning project from The Boulevard to Kralsangri on August 2 last year during a high level meeting. The CM had also approved Rs 60 crore for the project and directed the concerned departments to start the project on war-footing.
“I want the project on fast track. Traffic jamming and congested roads are putting the general public to great inconvenience. Our endeavor should be to concentrate on this subject positively and effectively to make a necessary dent”, the CM had stated.
However, sources said, in contravention of the original place, the Road and Buildings Department has floated the new proposal of constructing the 2,000 meter long concrete cantilever on The Boulevard extending into Dal Lake from Dalgate to Nehru Park.
“The original plan envisaged road widening from the right side of Boulevard which houses mostly parking slots and buildings of some hotels. Ironically, the plan has been changed to save the prized properties of some highly influential hoteliers who have connections in the State Government and the Centre. But the matter of concern is that the cantilever will be constructed at the cost of Dal Lake,” said a senior official wishing not to be named.
Environmentalists have expressed serious concern over the proposed construction of cantilever on The Boulevard saying it will be prove catastrophic for the Dal. “Any construction in Dal be it cantilever will tantamount to encroachment of the lake. What is painful is that this time the Government is itself an offender. The proposed construction of the cantilever along Dal banks defies logic. It seems the proposal has been floated on sheer influence and political pressure. If the wrong plan is executed, it will be a fatal blow for our beloved Dal,” said Aijaz Rasool, a noted environmentalist and hydraulic engineer.
“Dal’s outflow channel Chuntkul has already been vandalized by construction of a bridge. On one hand crores of rupees are being spent on Dal conservation and on the other Government is clearing decks for its vandalisation. We have to understand that restoring Dal to its pristine glory is important than widening of The Boulevard which has been designed to benefit some influential building owners on the stretch,” said Ajaz who is also a member of the Committee of Experts on Wullar, Tso-Morari and Mansar-Surinsar lakes under the Prime Minister’s Reconstruction Plan of Jammu and Kashmir.
The Chief Engineer of Roads and Buildings Department, Mushtaq Ahmad Lone, acknowledged that the department has proposed to construct the cantilever along The Boulevard.
“We are facing problems in acquisition of land and buildings on the stretch as it involves compensation of crores of rupees. We don’t have funds for it. We are weighing other options and construction of the cantilever along The Boulevard is also under consideration. The proposal has been sent to Government of India for sanction and we are awaiting funds and green signal from them,” the CE said.
He said to first phase of the four-laning project will be undertaken from Nehru Park to Kralsangri as the stretch is dotted with mostly Government land.
Chief Town Planner Iftikhar Hakeem said he has no information about the proposed construction of cantilever. “I was part of the meeting when the CM approved the four-laning project last year. But I don’t know anything about the construction of cantilever,” he said.
The Divisional Commissioner Kashmir Dr Asgar Samoon said according to High Court directions no construction is allowed within 100 meters from the lake. “I will look into the matter and ascertain details from the concerned department,” he said.
The vice-chairperson of the Lakes and Waterways Development Authority (LAWDA) Irfan Yasin maintained that sanctity of Dal Lake will be preserved at any cost.
He said the officials of Roads and Buildings department connected with the project had in their presentation to the CM maintained that maximum expansion will be undertaken on the right side of The Boulevard.
“There was a bottleneck of 100 meters near Dalgate and the R & B department proposed to construct cantilever to check the problem. We have categorically told the department that there is restriction on any sort of construction in the zone. We have not issued NOC to the department yet and advised its concerned officials to approach the High Court which is monitoring the conservation of Dal Lake,” Yasin said.

However, the snow clearance operations were started in late February which enabled early reopening of the road, the officials said.

Hoteliers suggest China model to contain pollution in Dal lake

Srinagar, June 1: Showing deep concern over the rising pollution levels in Dal lake, Kashmir Hotel and Restaurant Owners’ Federation (KHAROF) has suggested to the government to adopt China model to deal with the problem.
A delegation of the federation led by its president, Faiz Ahmad Bakshi, has presented a paper to Chief Minister, Omar Abdullah at a meeting here the other day, suggesting ways to contain pollution in Dal Lake.
The paper highlights the steps China has “successfully” taken to fight pollution in its Taihu lake.
The paper says that China has successfully dealt with the pollution in its Taihu lake, which is 100 times bigger in size than Dal lake.
Bakshi said the delegation stressed the need for developing infrastructure at tourist spots in synch with the environment and ecology of the place.

THE PAPER:
“Dal lake is infested with bacteria which is responsible for uncontrolled weed Azola.”
Quoting a report submitted by the State Pollution Control Board to J&K High Court, the paper reads: “The lake contains high levels of lead, arsenic, iron, manganese, copper, cadmium, etc.”
It says the growth of red and green Algae in the lake compounds its problems.
The papers reads: “A large number of residents live on the periphery of Dal lake whose solid and liquid waste directly goes into the lake. It is, therefore, very important that drains are constructed in this areas and connected with STPs.”
“There are hamlets, nearly 27 or so within the lake with a population of 40,000 souls who need to be relocated and their return to these hamlets prevented.”
“National Lake Conservation Programme under which Rs 298 corer were sanctioned in 2009, but released recently, for the development of Sewerage, removal of encroachments, aforestation, conservation works in catchment areas of the Dal Lake, etc, need to be pursued vigorously.”
“The houseboat owners need be taken on board by engaging them through confidence building measures and addressing their apprehensions.”
CHINESE MODEL
“China faced a situation similar to what we are facing in Dal Lake. The Taihu lake, one of the most scenic lakes in Eastern China with an area of 2250 Sq Kms ( about 100 times the area of Dal lake) and spread over two provinces of Zhejiang and Jiangsu had been ravaged by pollution, sewage, industrial and agricultural waste triggering algae that threatened water supply to millions of residents.”
“China tried many options but failed to clean the lake of the pollution. Finally, the government constituted a committee under the chairmanship of prime minister.”

WHAT THEY DID:
“After using different methods unsuccessfully, China found that instead of resorting to the use of mechanical methods, the answer lay in the use of a particular species of fish, Silver and Green Carp.”
“In 2009 the authorities put about 10 million fish into the lake. Buoyed by the results they put 30 million more fish into the lake during the years 2010 and 2011. These were mainly Green and Silver Carp.”

WILL THIS FISH WORK HERE
The Silver and Green Carp feed on weeds and Algae. They dig deep into the root of the weeds for food and uproot the weeds that increases the depth of the lake. Dal Lake suffers on both counts,
The Silver Carp survive from minus 10 to 35 degree Celsius.
The Silver carp suffer from high rate of mortality which is, however, offset by equally high rate of production.
Most importantly this carp can consume up to 50 kgs of algae and weeds during its lifetime but its weight grows by only 1 kg.
The species of this fish that can be suitable for Dal Lake is produced in (Hong Kong) China.

TAKE EXPERTS ON BOARD

"Last year, we used to turn down hundreds of booking requests but this time rooms are lying vacant as tourists have preferred Kashmir where they get more facilities and natural beauty in comparison to Himachal Pradesh," Karan said, as per a Times of India report by Anand Bodh.
Karan said that variation is temperature is biggest reason for tourist diversion to Kashmir.
He said in Himachal, tourists face the problems like water shortage, traffic chaos beside hot weather conditions. "Kashmir is packed till August and it is the spill over which is coming to Himachal Pradesh," he added.
Gajender Thakur, President, Manali hoteliers association said that May 2012 was a lean tourist season for them.
"Diversion of tourists to Kashmir was one reason, but there were other reasons too such as banning entry of tourists to Rohtang pass and the poor condition of roads," he said.
Thakur said that in May, lack of rainfall resulted in a rise in mercury levels but after rain and snow lashed higher reaches and brought down the temperature, tourist rush has increased to the hill town.
"For the last one week, we are having good tourist season," he said.
Arun Sharma, Director, Himachal Pradesh Tourism said that it would be premature to say that Himachal Pradesh has lost out to Kashmir this time.
"As compared to last year, tourist rush has increased in Himachal Pradesh. Actual count of tourist could be made only at the end of season and that would clear the picture," he said.

Will DoT's fresh direction end decade long SIM card war in Kashmir?

The department of telecommunication's (DoT) fresh directive, which puts every customer seeking second mobile SIM (Subscriber Identity Module) card in Jammu and Kashmir under police scrutiny, is likely to end decade long dirty mobile-phone tracking war in this militancy-ridden

Ever since mobile service was allowed in Kashmir in 2003, eight years after rest of the country, it became a major tool both for militants as well as for the counter-insurgency grid of security forces.
Lashkar-e-Toiba's operational commander Abdullah Unni and Jash-e-Muhammad's Qari Hamad earned sobriquet of being chameleons for frequently changing their mobile SIM cards. "Abdullah Unni must have used more than 30 SIM cards during his operation in north Kashmir's Sopore area. He would call at a particular mobile tower and switch to another SIM card to escape detection," said a senior counter-insurgency official on the condition of anonymity.
Unni, a foreigner, survived for more than six years in a state where a militant's life is not more than six months as per security forces records. Similarly, Hamad employed two dozen SIMs to give the police a slip. Both militants were killed in two separate encounters in 2011 after constantly being tracked on mobile phones.
To break in into militants ranks, the police used a counter trick. In 2010, the police succeeded in planting SIM cards into militant ranks through moles for easy detection. The messages, which many a times were floated by the police, pitted militant commanders against each other. The first victim of such constructed militant rivalry was a foreign militant of LeT! Numan, who is suspected to have been killed by a colleague in north Kashmir's Uri area in 2010 after discovering message from a police officer in his mobile phone.
Numan(彼の携帯電話で警官からメッセージを発見した後に2010年に北カシミールのUri地域で同僚に殺されたと思われます)。
Buoyed by the success of pushing SIM cards into militant ranks, the police would arrest or kill a militant at will. "Most militants had girl friends and would talk for hours together on known SIM cards, making it easy to zero in on them," said another police officer, part of operations in south Kashmir.
The police penetration through SIM cards can be gauged from the fact that police constable Mukhtar Ahmad Sheikh, a resident of Srinagar, succeeded in planting 22 SIM cards into the LeT ranks; the SIM cards were later found from slain militants involved in the 26/11 Mumbai attack by the National Investigating Agency (NIA).
The SIM card tracking war became ugly when Sheikh, along with two other constables, switched sides and started helping the Hizbul Mujahideen in 2012. The breakthrough in the 2012 militant-police nexus was made when the NIA tracked SIM cards of the three constables and found suspicious conversation with militant commander in south Kashmir.
Of late, according to police, militants are changing tactics too. Qari Yasir, operational commander of Jash-e-Muhammad, active in Lolab-Kupwara in north Kashmir, has procured dozens of SIM cards in advance but succeeds in remaining anonymous to the security forces' on-ground moles by using phone in forest areas and not populated locations.
The SIM card wars are now likely to be impacted on both sides with fresh DoT's directive for Jammu and Kashmir. On Tuesday, the DoT in New Delhi issued the letter to telecom operators asking them to refer to police the application forms of Jammu and Kashmir customers already having one active mobile connection.
The TSP (Telecom Service Providers) will not be able to provide second SIM in the state without police verification from February. In case the police fail to submit its reply within next 10 days, the Telecom operator can issue the second connection.
TSP(テレコミュニケーション・サービスProviders)は、2月から警察確認なしで国で第2のSIMを提供することができません。
"It is a good exercise that will help us maintain a data of those using multiple SIMs and can easily be tracked in case of any suspicion," said the police officer.

SRINAGAR - A young British woman holidaying in Kashmir was found dead in a pool of blood in her houseboat room alongside scenic Dal Lake, police Saturday said.
Richard De-Wit, a Dutch national, has been accused of smashing the latch on the houseboat cabin door of the 24-year-old British tourist and stabbing her to death. Police eventually arrested the accused, who was taken into custody as he tried to flee the Kashmir valley.
They said the woman, Sarah Groves, 24, from Guernsey, had been stabbed to death on a houseboat in her houseboat room. "We immediately reported to the spot and we walked into a pool of blood in her room," superintendent of police, Tahir Sajjad told Kashmir Observer. "We found a sharp-edged knife close, to her body. The young lady had multiple stab wounds."
The police officials were alerted early this morning by the owner of the New Beauty houseboat on Srinagar’s Dal Lake after he found the body of the young woman in her bedroom. He told police that a Dutch tourist who had also been staying at the property had left without his bags or shoes.
The houseboat’s owner, Abdul Rahim Shoda terms the death a “family loss” saying that the deceased woman had been staying with him for the last two months. “She was very nice lady and we would treat her as a family member now,” Shoda said, “three days ago, a Dutch tourist also took an adjoining room on the houseboat.” Narrating the incident in a shrill voice, “This morning my wife got up at 5AM and shouted to me to go out and buy bread. I could see that the door of the houseboat was already open,” Shoda said, who stays alongside the houseboat and noticed that his rowing boat, or shikara, was missing. “I went into the houseboat. He was not there. Then I saw Sarah. There was blood all over her body. I called my son and he took her to the hospital.”
Shoda said that he was able to trace the movements of the Dutch tourist by calling the taxi stand at the tourist office in Srinagar and asking if anyone had given a lift to such a person. He was told that a tall man without any shoes and with no luggage had taken a vehicle to Jammu. He said that Groves had taken a room two months ago. He said he had last seen her on Friday evening when he had a hot water bottle to her room. Pertinently, the Foreign Office lifted its warning against travel to the cities of Srinagar and Jammu last November, although warnings remained in force in the rest of Kashmir. The Kashmir valley has been enjoying a revamp of tourism, one of the mainstays of the local economy. The Foreign and Commonwealth Office in New Delhi reportedly said that her next of kin were informed. "We are aware of reports of an incident involving a British national in Srinagar, Kashmir, and are looking into it," a spokesman said.
'Police Patrol'
The state police were able to trace the registration number of the taxi and the Dutch tourist was intercepted near the town of Qazigund, around 40 miles south of Srinagar. Senior police officer Afad-ul-Mujtaba said the man, in his 40s, had been taken back to Srinagar, the summer capital of the state of Jammu and Kashmir. “He has been detained and his questioning is going on,” he said. Mujtaba said the police were awaiting the results of a post-mortem examination of the victim.
Human Rights Abuses in Kashmir
Posted: 07/12/2012 21:02
It is not clear to me why the human rights abuses within Jammu and Kashmir (Indian administered) have not been headline news all over the world. Certainly, the Indian media appears to have muted the events in Kashmir.
The types of abuses against civilians ongoing since the 1990s include: mass killings, forced disappearances, torture, rape, sexual abuse, political repression and suppression of free speech. Those accused are the Indian central reserve police force, border security personnel and militant groups. In 2010, the UK's Guardian newspapers described dispatches obtained by Wiki-Leaks. US officials had evidence of widespread torture by the Indian police and security forces. US diplomats in Delhi were briefed in 2005 by the International Committee of the Red Cross [ICRC] about the use of electrocution, beatings and sexual humiliation against hundreds of detainees. In 2010, the Times of India wrote
"According to the latest statistics, the number of civilians killed in firings by security forces is almost three times the number of those killed in actions by terrorists".
In July 1990, the Indian military was given special powers under Armed Forces (Special Powers) Act, 1958(AFSPA). At the time, human rights groups claimed that this gave the security force blanket immunity against any crimes committed. Calls for a change have been unsuccessful. Senior army officials pointed out that in Manipur, the withdrawal of AFSPA from urban centres led to a surge in violence in those areas. More recently, the government stated it as not prudent to repeal the AFSPA . The International Business Times wrote:
"Defence Minister AK Antony said last month that hasty decisions could not be taken regarding the withdrawal of the Act since infiltration from across the Line of Control (LoC) had increased. The Defence Ministry and the Army have been strongly opposing withdrawal of the AFSPA from the state, saying that such a step could adversely impact the security architecture in the region"
Human Rights Watch has produced some vital reports regarding the human rights abuses meted out on the people of Kashmir since the early 1990s. Their 1996 report "Human Rights Watch, India's Secret Army in Kashmir: New Patterns of Abuse Emerge in the Conflict, and 1 May 1996" is a harrowing read. Their report Human Rights Crisis in Kashmir can be downloaded here. Asian Watch and Physicians for Human Rights have also reported their findings, stating:
"Indian forces in Kashmir have engaged in massive human rights violations, including extrajudicial executions, rape, torture and deliberate assaults on health care workers. Armed insurgent groups have murdered Hindu and Muslim civilians, summarily executed persons in their custody and have committed rape, assault, kidnapping and indiscriminate attacks which have injured and killed civilians".
When inquiries have been ordered into these allegations of abuses, the investigations are frequently never conducted and the findings not made public. The Indian government has been largely dismissive of many of the allegations raised. The report Rape in Kashmir was equally critical.
The cumulative result is a community struggling from day to day. Kashmir has one of the highest rates of psychiatric morbidity in the world. Kashmir Global summarises the situation here.
A recent report in BBC World News, dated 6th December 2012, summarises the contents of the recently released report constructed by the International People's Tribunal on Human Rights and Justice . The document, entitled "Perpetrators - Stories of Impunity in Jammu and Kashmir at a press conference on Thursday, December 06, 2012" , analysed 214 cases of abuse and highlighted the various roles of officials. Evidence includes official documentation as well as witnesses. During the release of the report in Srinagar, Mr Kartik Murukutla, a human rights lawyer and one of the authors of the report, said India's priority in Kashmir was to control the territory not to pursue justice. He said
"For the victims, the wait for proper justice seems perpetual. In its approach to justice, the Indian state has not moved beyond cash relief or the promise of re-investigation."
"The state has wilfully lowered the standard of justice as well as the crimes perpetrated," he said.
The group stated
"Cases presented in this report reveal that there is a policy not to genuinely investigate or prosecute the armed forces for human rights violations. There is an occasional willingness to order compensatory relief, but not to bring the perpetrators to justice. On the contrary, alleged perpetrators of crimes are awarded, rewarded and promoted by the State"
According to the Guardian newspapers, the Indian forces have refused to comment . It summarised the situation as follows
"Up to 70,000 people died in violence in Kashmir over recent decades, it is widely estimated. Civilians and security forces were killed in a series of suicide-style attacks and bombings. Such attacks justified the hard-line often taken by security forces, former officers say. However, as the intensity of the conflict has ebbed in recent years, there has been a steady stream of revelations detailing abuses. In recent years, dozens of unmarked graves containing more than 2,000 corpses have been discovered on the Indian side of the line of control, the de facto border that has split the former kingdom between India and Pakistan for nearly 40 years."
In summary, despite the death toll of civilians, there does not appear to be any constructive action taken by the Indian government to prevent these atrocities. Many Indians are protective of their army, refusing to consider the possibility that these allegations require further inquiries. Concerns related to human rights violations were also raised by the United Nations . The Working Group remains concerned about allegations of a widespread practice of enforced disappearances between 1989 and 2009 and the existence of mass graves. In the meantime, the abuses of human rights continue while those in control turn a blind eye to the situation - lives are being destroyed and relationships fractured beyond repair.
