〔Advocating genocide〕 〔大量虐殺の支持〕 318. (1) Every one who advocates or promotes genocide is guilty of an indictable offence and liable to imprisonment for a term not exceeding five years. 第318条第1項 大量虐殺を支持もしくは奨励する発言を為したる者は誰でも、起訴犯罪で有罪とし、5年以下の禁固に処す。
〔Definition of “genocide”〕 〔「大量虐殺」の定義〕 (2) In this section, “genocide” means any of the following acts committed with intent to destroy in whole or in part any identifiable group, namely, 第2項 本条でいう「大量虐殺」とは、定義可能な集団の全体もしくは一部を破壊する意図で行われる、以下にのべる行為を指す。すなわち、 (a) killing members of the group; or (a) 集団のメンバーを殺害すること、または、 (b) deliberately inflicting on the group conditions of life calculated to bring about its physical destruction. (b) 故意に、集団に肉体的な破壊をもたらすこと。
〔Consent〕 〔同 意〕 (3) No proceeding for an offence under this section shall be instituted without the consent of the Attorney General. 第3項 本条に基づく犯罪のいかなる手続きも、司法長官の同意なくして開始されてはならない。
〔Definition of “identifiable group”〕 〔「定義可能な集団」の定義〕 (4) In this section, “identifiable group” means any section of the public distinguished by colour, race, religion, ethnic origin or sexual orientation. 第4項 本条でいう「定義可能な集団」とは、肌の色、人種、宗教、民族の起源あるいは性的指向によって特徴づけられる人の集団をいう。
〔Public incitement of hatred〕 〔憎悪の公共での煽動〕 319. (1) Every one who, by communicating statements in any public place, incites hatred against any identifiable group where such incitement is likely to lead to a breach of the peace is guilty of 第319条第1項 あらゆる公共の場において、伝達可能な発言を行うことにより、いずれかの定義可能な集団に対し憎悪を煽動するすべての者は、当該煽動が治安紊乱をひき起こす可能性が高いときは、以下の刑に処す。 (a) an indictable offence and is liable to imprisonment for a term not exceeding two years; or (a) 2年以下の禁固または、 (b) an offence punishable on summary conviction. (b) 略式裁判により有罪とする。
〔Wilful promotion of hatred〕 〔憎悪の意図的促進〕 (2) Every one who, by communicating statements, other than in private conversation, wilfully promotes hatred against any identifiable group is guilty of 第2項 私的な会話を除き、どの定義可能な集団に対しても、憎悪の感情を意図的に促進する発言を為したる者は以下の刑に処す。 (a) an indictable offence and is liable to imprisonment for a term not exceeding two years; or (a) 2年以下の禁固または、 (b) an offence punishable on summary conviction. (b) 略式裁判により有罪とする。
〔Defences〕 〔免責事項〕 (3) No person shall be convicted of an offence under subsection (2) 第3項 以下の条件に該当する者は、第2項によって有罪を宣告されない。 (a) if he establishes that the statements communicated were true; (a) 語った内容が真実であることを証明した場合。 (b) if, in good faith, the person expressed or attempted to establish by an argument an opinion on a religious subject or an opinion based on a belief in a religious text; (b) 善意に基づき、経典に基づく宗教上の問題について議論や意見を唱えた場合。 (c) if the statements were relevant to any subject of public interest, the discussion of which was for the public benefit, and if on reasonable grounds he believed them to be true; or (c) 発言が公共の関心に基づく問題で、議論することが公共の利益となり、かつ、発言者が合理的見地から真実であると信じていた場合、または、 (d) if, in good faith, he intended to point out, for the purpose of removal, matters producing or tending to produce feelings of hatred toward an identifiable group in Canada. (d) 善意に基づき、カナダの定義可能な集団に対する憎悪の感情を生み出しまたは生み出すことを助長する資料を、除去する目的で指し示す場合。
〔Forfeiture〕 〔没収〕 (4) Where a person is convicted of an offence under section 318 or subsection (1) or (2) of this section, anything by means of or in relation to which the offence was committed, on such conviction, may, in addition to any other punishment imposed, be ordered by the presiding provincial court judge or judge to be forfeited to Her Majesty in right of the province in which that person is convicted, for disposal as the Attorney General may direct. 第4項 第318条または本条第1項または第2項に基づく犯罪について有罪の判決を受けた者は、当該犯罪を行う手段として用いられたか、もしくは当該犯罪の遂行と関係する物について、当該有罪判決と同時に、ほかに何らかの刑罰が科される場合はこれに併科して、州裁判所の首席裁判官またはその他の裁判官の命令により、当該の者が有罪判決を受けた州の権限によって女王陛下の名の下にこれを没収し、司法長官の指示に従い処分することができる。
〔Exemption from seizure of communication facilities〕 〔通信施設の押収の免除〕 (5) Subsections 199(6) and (7) apply with such modifications as the circumstances require to section 318 or subsection (1) or (2) of this section. 第5項 第199条第6項および第7項は、第318条または本条第1項もしくは第2項について、事情により必要とされる修正を加えて準用する。
〔Consent〕 〔同意〕 (6) No proceeding for an offence under subsection (2) shall be instituted without the consent of the Attorney General. 第6項 第2項に基づく犯罪のいかなる手続きも、司法長官の同意なくして開始されてはならない。
〔Definitions〕 〔定義〕 (7) In this section, 本条において、 “communicating” includes communicating by telephone, broadcasting or other audible or visible means; 「伝達」とは、電話、放送またはその他の聴覚手段もしくは視覚手段による伝達を含む。 “identifiable group” has the same meaning as in section 318; 「定義可能な集団」とは、第318条と同義である。 “public place” includes any place to which the public have access as of right or by invitation, express or implied; 「公共の場所」とは、明示的もしくは黙示的な権利あるいは招待により、公衆がアクセスできるあらゆる場所を含む。 “statements” includes words spoken or written or recorded electronically or electro-magnetically or otherwise, and gestures, signs or other visible representations. 「発言」には、口頭または書面による言葉、あるいは電子的または電磁的な、あるいはその他の手段により記録された言葉、もしくはしぐさ、手ぶりまたはその他の視覚的表現を含む。
トランプ大統領を支持する客がレストランでサービスを拒否された事件で、店員が解雇された。
バンクーバーのスタンレーパーク内にあるレストラン「ティーハウス」に6月26日、トランプ氏が掲げたモットー“Make America Great Again”(アメリカを再び偉大にしよう)の書かれた赤い帽子をかぶった男性が入店した。ウェイターのダーリン・ホッジ氏がテーブルに行き、帽子を脱ぐよう要求すると、客はそれを被る権利があると答えた。ホッジ氏が「帽子を脱がないとサービスしない」と告げると、客は出て行ったという。
レストランを経営するセコイア社は、ホッジ氏を28日に解雇した。マネージャーのアンディ・クリンプ氏は、次のように述べた。
「我々は、いかなる種類の非寛容も支持しない。」
「我々は人を、政治的信条に基づいて差別しない。」
ホッジ氏は、会社の決定は受け容れたものの、解雇の翌29日にフェイスブックで声明を発表した。
「MAGAの帽子は、人種差別・偏狭・イスラムフォビア・女性蔑視・白人優位主義・同性愛嫌悪を象徴している。強いモラルを持つ者として、私の職場において、この客の帽子のセンスに対し明確な態度を示す必要があった。少しも後悔していない。」
