Thailand’s New Retail Act Advocate Roi Bak Thailand’s New Retail Act
Roi Bak, Advocate1
In an article published by the undersigned on February earlier this year2, dealing with the fair competition (anti trust) policy in Thailand (a legal analysis of the Thai Trade Competition Act), the issue of big foreign retailers versus the small retail shops (as the mom-and-pop shops) and traditional wholesalers, was raised.
Several major retailers, Tesco-Lutus, Carefour, Big C, Makro (the “Foreign Retailers”) have entered the Thai market pursuant to the economic crisis occurred in Thailand and Asia on 1997. Such Foreign Retailers attracted more Foreign Direct Investment (FDI) which was and still is so crucial for a developing country as Thailand.
However, in addition to FDI, western marketing methods, awareness, and a variety of consumable products for the benefit of the consumers in Thailand, it is argued that the Foreign Retailers have breached the fragile competitive balance existed in Thailand between the traditional retailers and wholesales, by implementing unfair competitive methods.
